Terms of Service

I. General Concepts

  • Terms and Conditions – these terms and conditions
  • Service – the internet service “DeCure”, operating at https://decure.com.pl
  • Service Provider – the company “DE CURE MEDICAL RESEARCH SP. Z O.O.” with registered office at: ul. JANA CZECZOTA 31/— 02-607 WARSAW, NIP: 5213856957, KRS: 0000769463,
  • Service Recipient – any natural person accessing the Service and using the services provided through the Service by the Service Provider.
  • Electronic Communication – Communication between parties via electronic mail (e-mail) and contact forms available on the website.

II. General Provisions

  • The Terms and Conditions define the rules of functioning and use of the Service and specify the scope of rights and obligations of Service Recipients and the Service Provider related to the use of the Service.
  • The subject of the Service Provider’s services is the provision of free tools in the form of the Service, enabling Service Recipients to access content in the form of posts, articles and audiovisual materials or internet applications and electronic forms
  • Any potential content, articles and information containing features of tips or advice published on the Service are only a general collection of information and are not directed to individual Service Recipients. The Service Provider is not responsible for their use by Service Recipients.
  • The Service Recipient takes full responsibility for the way of using the materials made available within the Service, including their use in accordance with applicable law.
  • The Service Provider does not provide any guarantee as to the usefulness of the materials placed in the Service.
  • The Service Provider is not liable for any damages incurred by Service Recipients or third parties in connection with the use of the Service. All risks associated with the use of the Service, and in particular with the use and utilization of information placed in the Service, are borne by the Service Recipient using the Service.

III. Conditions of Using the Service

  • The use of the Service by each of the Service Recipients is free of charge and voluntary.
  • Service Recipients are obliged to read the Terms and Conditions and other documents constituting its integral part and must accept its provisions in full in order to continue using the Service.
  • Service Recipients may not use any personal data obtained in the Service for marketing purposes.
  • Technical requirements for using the Service:
    • a device with a display capable of displaying web pages,
    • internet connection,
    • any web browser that displays web pages in accordance with W3C Consortium standards and provisions and supports web pages provided in HTML5,
    • JavaScript enabled,
    • Cookie files enabled
  • In order to ensure the security of the Service Provider, the Service Recipient and other Service Recipients using the Service, all Service Recipients using the Service should follow the generally accepted network security principles,
  • It is forbidden to perform actions personally by Service Recipients or using software:
    • without written consent, decompilation and analysis of the source code,
    • without written consent, causing excessive load on the Service server,
    • without written consent, attempts to detect vulnerabilities in the Service’s security and server configuration,
    • attempts to upload or inject code, scripts and software that may harm the Service software, other Service Recipients or the Service Provider,
    • attempts to upload or inject code, scripts and software that may track or steal data of Service Recipients or the Service Provider,
    • taking any actions aimed at damaging, blocking the operation of the Service or preventing the realization of the purpose for which the Service operates.
  • In case of detecting the occurrence or potential possibility of a Cybersecurity incident or GDPR violation, Service Recipients should first report this fact to the Service Provider in order to quickly remove the problem / threat and secure the interests of all Service Recipients of the Service.

IV. Conditions for Providing the Newsletter Service

  • Service Recipients can use the Service without the need to subscribe to the Newsletter.
  • Subscribing to the Newsletter service is voluntary.
  • Subscribing to the Newsletter service is free of charge.
  • Technical requirements related to the Newsletter service:
    • having an individual e-mail account,
  • Conditions for providing the Newsletter service:
    • providing an individual e-mail account in the electronic form,
    • verification of the provided e-mail account by activating the link sent to it,
    • consent to receive e-mail notifications,
  • Scope of the Newsletter service:
    • notifying about new updates, posts, contests, and other promotional actions related to the Service’s services,
    • notifying about promotional actions of the Service’s partners (Marketing messages),
  • Unsubscribing from the Newsletter service:
    • Each Service Recipient subscribed to the Newsletter service has the possibility to unsubscribe from the Service on their own.
    • Service Recipients can do this through the link included in each sent e-mail message.
    • Unsubscribing from the Newsletter service results in the removal of the provided e-mail address from the Service Provider’s database.

V. Conditions of Communication and Provision of other Services in the Service

  • The Service provides services and tools enabling Service Recipients to interact with the Service in the form of:
    • Contact Form
    • Commenting on posts and articles
  • The Service provides contact details in the form of:
    • E-mail address
    • Contact phone number
  • In case of contact between the Service Recipient and the Service Provider, the personal data of Service Recipients will be processed in accordance with the “Privacy Policy”, which is an integral part of the Terms and Conditions.
  • Conditions for placing content by Service Recipients in the Service:
    • It is forbidden to place offensive or defamatory content in the Service towards the Service Provider, other Service Recipients, third parties and third-party entities,
    • It is forbidden to place in the Service text, graphic, audiovisual materials, scripts, programs and other works for which the Service Recipient does not have a license, or for which the author of property rights has not agreed to free publication,
    • It is forbidden to place in the Service vulgar, pornographic, erotic content and content inconsistent with Polish and European law, as well as links to pages containing such content,
    • It is forbidden to place in the Service scripts and programs excessively burdening the server, illegal software, software used to breach security and other similar activities, as well as links to pages containing such materials,
    • It is forbidden to place in the Service marketing content and advertising other commercial services, products, services or commercial websites

VI. Collecting Data about Service Recipients

In order to properly provide services through the Service, secure the legal interest of the Service Provider and to ensure compliance of the Service’s operation with applicable law, the Service Provider collects and processes certain data about Users through the Service.

In order to properly provide services, the Service uses and records some anonymous information about the Service Recipient in cookies.

The scope, purposes, manner and principles of data processing are available in the appendices to the Terms and Conditions: “GDPR Information Obligation” and in the “Privacy Policy“, which are an integral part of the Terms and Conditions.

    For the smooth operation of the Service and for statistics, we automatically collect some data about the Service Recipient. This data includes:
    • IP Address
    • Browser type
    • Screen resolution
    • Approximate location
    • Opened subpages of the service
    • Time spent on a specific subpage of the service
    • Type of operating system
    • Previous subpage address
    • Referring page address
    • Browser language
    • Internet connection speed
    • Internet service provider
    • Anonymous demographic data based on Google Analytics data:
      • Gender
      • Age
      • Interests

    The above data is obtained through the Google Analytics script and is anonymous.

  • Data collected during newsletter subscription:
    e-mail address

VII. Copyright

  • The owner of the Service and the copyright to the service is the Service Provider.
  • Some of the data posted in the Service is protected by copyrights belonging to companies, institutions and third parties not associated in any way with the Service Provider, and is used based on obtained licenses or based on free licenses.
  • Based on the Act of February 4, 1994 on copyright law, it is forbidden to use, copy, reproduce in any form and store in search systems, excluding Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn search engines, any articles, descriptions, photos and any other content, graphic materials, video or audio found in the Service without written consent or consent given via Electronic Communication from their legal owner.
  • According to the Act of February 4, 1994 on copyright law, simple press information, understood as information alone, without commentary and evaluation by their author, is not subject to protection. The author understands this as the possibility of using information from texts posted in the service, but not copying all or part of articles unless it has been marked in the particular material made available in the Service.

VIII. Changes to the Terms and Conditions

  • All provisions of the Terms and Conditions may be unilaterally changed by the Service Provider at any time, without giving reasons.
  • Changes to the Terms and Conditions come into force immediately after their publication.
  • It is considered that each Service Recipient, continuing to use the Service after the change of the Terms and Conditions, accepts it in its entirety.

IX. Final Provisions

  • The Service Provider is not responsible in any way, as only allowed by applicable law, for the content transmitted and published in the Service by Service Recipients, for their truthfulness, reliability, authenticity or legal defects.
  • The Service Provider will make every effort to ensure that the Service’s services are offered continuously. However, it does not bear any responsibility for disruptions caused by force majeure or unauthorized interference by Service Recipients, third parties or the activity of external automatic programs.
  • The Service Provider reserves the right to change any information placed in the Service at a time chosen by the Service Provider, without the need to notify Service Recipients using the Service’s services in advance.
  • The Service Provider reserves the right to temporarily, totally or partially disable the Service for its improvement, adding services or maintenance, without prior notice to Service Recipients.
  • The Service Provider reserves the right to permanently disable the Service without prior notice to Service Recipients.
  • The Service Provider reserves the right to assign in part or in full all of its rights and obligations related to the Service, without the consent and possibility of expressing any objections by Service Recipients.
